Here's another letter sent in by a resident:
During the City Council Meeting on July 10, 2023 (https://www.youtube.com/watch?v=YZt1hwU8BDU at 21:30) I addressed council with the concern that the Mayor, Councilwoman Crespo and Councilman Plain had violated OML, just as they had accused Council members Long, Turini, Whittman and Thomas of doing. Councilman Plain refuted that notion (at 1:08:10) stating that
1. CML was noticed on the City's website,
2. CML is open to the public,
3. "Entire council" was there and "attended classes, meetings, luncheons" etc.
4. "Gathering referenced during public comment actually happened during the conference, on-site, so it was above board."
While CML was indeed noticed on the City of Dacono's website, you can go to the agenda center to find this, Mayor Morehead was NOT registered for CML. Let me say that again...Mayor Morehead did NOT register for CML. (See CORA request below in picture)
In order to attend CML, one must be registered for CML. Per the CML handbook from June 2023, "Everyone in the conference center and all meeting rooms must be registered and have a name badge to enter and attend sessions and events." This statement is found on every day of the conference under the registration section of the daily agenda. (If you would like to see this document for yourself, here is the link:
The photo in question was posted by Doris Crespo on her InstaGram page on Tuesday, June 27, 2023, and has a time stamp of 6:53pm. CML ended at 5:15pm on Tuesday, June 27, 2023.
The location of the photo holds no weight in this matter. CML was over for the day.
Tuesday, June 27, 2023 happened to be the day the recall of Thomas and Turini occurred.
This definitely does not look to be "above board" as Councilman Plain stated. If the Mayor did not register for CML, he couldn't attend any of the CML events...he couldn't even be in the event center itself. It appears he joined the Crespo's and Plain's to celebrate the recall results and in doing so, these three present members of council violated Open Meetings Law as they celebrated recalling two of their own members who were accused of, not proven guilty of, violating the same laws.
